Asleep in Car = At Work? PA Appellate Court Says "Yes".

In the case of <i>Kulik v. Mash</i>, the plaintiff arrived for work early, so he decided to nap in his car in his employer's parking lot. While he was napping, a co-worker arriving for work rammed his car into the plaintiff's thereby causing injuries. The question posited for the court was whether the Worker's Compensation Act barred coverage. The Superior Court agreed with the trial court and held that it did. The court held that "waiting for work was within the scope of employment."
