PA Superior Court Addresses Landowner Liability.

January 29, 2008

In the case of Jones v. Levin (PICS Case No. 08-0110 (Pa Super. Dec. 31, 2007)), the Superior Court clarified the extent and scope of a landowner/employer’s responsibility for accidents suffered by the landowner’s employee in a public area (as opposed to an area where only employees have access). Relying on New York case law (as there was no dispositive PA case law on point), the Superior Court held that a landowner can be liable for employee injuries if said injuries occurred in a public area.
